Fahrnisrecht bezeichnet das Sachenrecht der beweglichen Sachen im Gegensatz zum Liegenschaftsrecht. Fahrnisvollstreckung bezeichnet die Mobiliarzwangsvollstreckung. In älteren Texten werden die Wörter farnis, farnus, varnde, fliegende oder rührende habe, varende oder roerende goedern verwendet im Gegensatz zu eigen, erbe, legendes gut, onroerende goederen. Zur Fahrnis zählen also alle Sachen, die weder Grundstücke noch Bestandteile von Grundstücken sind. Beweglich bezeichnet daher in erster Linie die natürliche Eigenschaft einer Sache. So sagt schon der Schwabenspiegel in 168 a: „waz varende gut heizet, daz suln wir iu sagen. Golt, silber, edel gesteine, vie, ros und allez, daz man triben und tragen mag.“ Dazu gehörten auch nicht mit dem Boden verbundene Holzgebäude, alles, was nicht niet- und nagelfest war. Für Holzhäuser galt: „Was die Fackel zehrt, ist Fahrnis.“ Im römischen Recht gehörten auch Sklaven zur Fahrnis. |

Dette skjer på den måten at rettigheter og heftelser blir registrert på den fysiske eller juridiske personen som har eiendomsretten til tingen. Pantsetting av løsøre vil normalt bare kunne skje ved overlevering (håndpant), men det gjelder visse unntak fra dette. Blant annet kan visse former for løsøre som kan registreres i et realregister, pantsettes ved at panteretten registreres på eiendelens blad i dette registeret. Slike registre, som fungerer omtrent som ved tinglysing av fast eiendom, finnes i Norge for skip, skip under bygging og luftfartøyer. Enkelte andre former for løsøre kan pantsettes sammen med den faste eiendommen de er tilknyttet, blant annet gjelder dette driftstilbehør av forskjellig slag.
